4-2016 Regulatory decision on LTE frequency

Pursuant to art. 56, clause 1, item 1 of the Law of 29 July 2005 on public offering and the conditions for introducing financial instruments to the organised trading system and on public companies (Journal of Laws of 2005, No. 184, item 1539, with amendments), the Management Board of Orange Polska S.A. (“Orange Polska”) informs about the receipt by Orange Polska of a reservation decision on LTE frequency issued by the President of Office Electronics Communication (“UKE”) .

On January 25, 2016, Orange Polska received decisions in which the President of the UKE has granted Orange Polska the frequencies in the 800 MHz and 2600 MHz bands. On the basis of these decisions Orange Polska has received the licenses of the two blocks of 2x5 MHz each in the 800 MHz band (blocks A and B) and licenses for three blocks of 2x5 MHz each in the 2600 MHz band (blocks J, K and L). The frequency licenses are valid for 15 years from the date of receipt of the decision (the decision is bearing the clause of immediate execution). Deadline for payment of the amounts declared in the auction is 14 days from the date of the receipt of the decision. Orange Polska is obliged to pay the amount of PLN 3,168 million for the above mentioned frequencies, however, this amount includes the bid bond paid before the auction.
“We are pleased to receive reservations for the LTE frequencies, bought at the auction. It is very good news for our customers and the company. Now we want to start investments and launch services to our customers based on the purchased 800 and 2600 MHz frequencies as soon as possible. We have financial resources to pay for the reservation fees and we will do it in due time” – said Bruno Duthoit CEO of Orange Polska.
