Pursuant to art. 56, clause 1, item 1 of the Law of 29 July 2005 on public offering and the conditions for introducing financial instruments to the organised trading system and on public companies (Journal of Laws of 2005, No. 184, item 1539, with amendments), the Management Board of Orange Polska S.A. (“Orange Polska”) informs about verdict of the General Court of the European Union.
December 17, 2015: The General Court of the European Union issued the verdict regarding the fine that the European Commission imposed on Orange Polska. The Court dismissed Orange Polska’s appeal from the decision of the European Commission and maintained the fine in the original amount of EUR 127.6m.
Orange Polska is analyzing the verdict issued by the General Court. We consider filing of an appeal. We have always thought the fine imposed by the European Commission, related to irregularities which took place before 2010, was too high. We are disappointed that neither the Commission nor the Court took into consideration significant actions and circumstances which, in our opinion, should contribute to reduction of the fine. Sustaining of the fine has no reference to the current situation whatsoever, not to mention our positive influence on the Polish telecommunication market. Orange Polska has established a financial reserve to cover the fine.
